1. Introduction

Welcome to Floletics (the “Services”), which includes the Floletics mobile application (the “App”) and the Floletics website (the “Website”).

Floletics LLC (“Floletics,” “we,” “us,” or “the Company”) is committed to protecting your privacy. This Privacy Policy (“Policy”) explains how we collect, use, disclose, store, and safeguard your information when you access or use our Services.

This Policy applies to all users of the Floletics App and Website, regardless of location.

By accessing or using the Services, you acknowledge that your information will be collected, used, and processed in accordance with this Privacy Policy. If you do not agree with the terms of this Policy, you should discontinue use of the Services.

2. Information We Collect

We collect only the information necessary to provide, operate, maintain, and improve the Services in a lawful, fair, and transparent manner.

(a) Automatically Collected Information

When you access or use the Services, certain device and usage information may be collected automatically, including:

  • device model and operating system version;
  • IP address and network type;
  • browser type and version (for Website access);
  • pages viewed, features used, and time spent within the Services;
  • access times, crash reports, and error logs.

This information is used to maintain system security, diagnose technical issues, and improve the performance and reliability of the Services.

(b) Account Information

When you create or use an account, we collect information necessary to provide authentication and account management, including:

  • email address;
  • verification code used for authentication.

You may optionally provide additional profile information, such as a nickname or profile photo. This information is voluntary and is not required to access the core features of the Services.

(c) Subscription and Payment Information

If you purchase a subscription through the App, payments are processed exclusively by Apple’s In-App Purchase system. Floletics receives only limited transaction information necessary to manage subscriptions and provide customer support, including:

  • order or transaction ID;
  • purchase amount;
  • subscription status.

Floletics does not collect, process, or store payment card numbers, banking information, or payment credentials of any kind.

(d) Analytics and Performance Data

The Services may use analytics tools to monitor performance and user experience. If third-party analytics SDKs are integrated (such as Firebase or similar), such tools may collect aggregated, pseudonymized data about app usage. We will update this Policy to identify any specific analytics providers we use. All analytics data is used solely to improve the Services and is not used for advertising or cross-app tracking.

If you wish to limit analytics data collection, you may do so through your device’s privacy or tracking settings (see Section 3).

3. Cookies and Tracking Technologies

The Services may use cookies and similar technologies (such as local storage, device identifiers, and analytics tools) to enhance functionality and user experience. These technologies may be used on both the App and Website to:

  • keep you signed in to your account;
  • remember your preferences and settings;
  • analyze usage patterns and improve performance;
  • enhance content delivery and playback quality.

Floletics does not use cookies or tracking technologies for advertising purposes.

App Tracking Transparency (iOS)

In accordance with Apple’s App Tracking Transparency (ATT) framework, if our App requests permission to track your activity across other companies’ apps and websites, we will ask for your explicit permission before doing so. You may grant or deny this permission through the on-device prompt, and you can change your preference at any time in your device’s Settings > Privacy > Tracking.

If you do not grant tracking permission, your experience of the Services will not be diminished. We do not use data for targeted advertising.

Managing Cookies

You may manage or disable cookies and similar technologies through your device or browser settings. However, certain features of the Services may not function properly if these technologies are disabled.

4. How We Use Your Information

We use the information we collect for the following purposes:

  • to create and manage your account and authenticate your identity;
  • to provide, maintain, and improve the Services;
  • to process subscriptions and manage billing-related communications;
  • to respond to your customer support inquiries and requests;
  • to send you important notices, updates, and policy changes;
  • to detect, investigate, and prevent fraudulent or unauthorized activity;
  • to comply with applicable legal obligations;
  • to analyze usage trends and improve app performance (using aggregated or anonymized data).

We will not use your information for purposes that are incompatible with those listed above without first obtaining your consent or as otherwise permitted by law.

5. Information Sharing, Transfer, and Disclosure

Floletics does not sell or rent your personal information to any third party.

We may share or disclose information only in the following limited circumstances:

(a) Service Providers

We may share information with trusted third-party service providers that assist us in operating, maintaining, and improving the Services — such as cloud hosting providers, payment processors, and analytics services. These providers are contractually required to handle your information securely and only for authorized purposes on our behalf.

(b) Legal Compliance

We may disclose information when required to comply with applicable laws, regulations, legal processes, or governmental requests, or to protect the rights, property, and safety of Floletics, our users, or others.

(c) Business Transfers

Your information may be transferred in connection with a merger, acquisition, financing, or sale of all or a portion of our business or assets. In such cases, we will take reasonable steps to ensure your information remains protected and that users are notified of any material changes to this Policy.

(d) With Your Consent

We may share your information for other purposes with your explicit prior consent.

6. Storage and Protection of Information

(a) Data Storage Location

Your information may be stored and processed in the United States and on secure servers operated by trusted cloud infrastructure providers, which may include AliCloud International nodes. By using the Services, you consent to the transfer and storage of your information in these locations.

(b) Data Retention

We retain personal information only for as long as necessary to fulfill the purposes described in this Privacy Policy, including providing and improving the Services and complying with applicable legal obligations.

If you delete your account, we will delete or anonymize your personal information within a reasonable period, unless retention is required or permitted by applicable law.

(c) Cross-Border Data Transfers

Your information may be transferred to and processed in countries outside your country of residence, including the United States, where data protection laws may differ from those in your jurisdiction. When transferring data internationally, we implement appropriate safeguards, including contractual protections (such as Standard Contractual Clauses where applicable), to ensure your information remains protected in accordance with this Policy and applicable privacy law.

(d) Security Measures

We implement industry-standard technical and organizational measures to protect your information, including encryption in transit (TLS/SSL), access controls, and system monitoring.

No method of transmission over the internet or electronic storage is completely secure. While we take reasonable steps to protect your information, we cannot guarantee absolute security. In the event of a data security incident materially affecting your personal information, we will notify affected users and relevant authorities as required by applicable law.

7. Your Rights

Depending on your location and applicable laws, you may have certain rights regarding your personal information. These rights may include the right to:

  • access a copy of the personal information we hold about you;
  • request correction of inaccurate or incomplete information;
  • request deletion of your personal information (“right to be forgotten”);
  • object to or restrict certain types of data processing;
  • data portability — receive your information in a commonly used, machine-readable format;
  • withdraw consent for consent-based processing at any time, without affecting the lawfulness of prior processing.

In-App Account Deletion

In accordance with Apple App Store requirements, you may request deletion of your account and associated personal data directly through the App or by contacting us at support@floletics.com. Upon a valid deletion request, we will delete or anonymize your personal data within a commercially reasonable time, subject to legal retention requirements.

EU/EEA Users — GDPR Rights

If you are located in the European Union or European Economic Area, you have the rights described above under the General Data Protection Regulation (GDPR). You also have the right to lodge a complaint with your local data protection supervisory authority if you believe your rights have been violated.

Our legal bases for processing personal data under the GDPR include: (i) performance of a contract (providing the Services); (ii) compliance with legal obligations; (iii) our legitimate interests (security, fraud prevention, service improvement); and (iv) your consent, where applicable.

California Users — CCPA/CPRA Rights

If you are a California resident, you have the following additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA):

  • the right to know what personal information is collected, used, shared, or sold;
  • the right to delete personal information we have collected about you;
  • the right to correct inaccurate personal information;
  • the right to opt out of the sale or sharing of your personal information (note: Floletics does not sell or share personal information for cross-context behavioral advertising);
  • the right to non-discrimination for exercising your privacy rights.

To exercise your California privacy rights, please contact us using the information in Section 12. We will respond within 45 days as required by law.

How to Exercise Your Rights

To submit any privacy-related request, please contact us at support@floletics.com with the subject line “Privacy Request.” We will respond within the timeframe required by applicable law (typically 30 days, or 45 days for California residents).

8. Protection of Minors

The Services are intended for individuals who are at least 18 years old. Users between the ages of 13 and 17 may use the Services only with the involvement and verified consent of a parent or legal guardian.

We do not knowingly collect, use, or store personal information from children under the age of 13. If we become aware that personal information from a child under 13 has been collected without appropriate verifiable parental consent, we will take immediate steps to delete such information.

If a parent or guardian believes that a minor has provided personal information without proper consent, they should contact us at support@floletics.com so we can investigate and take appropriate action.

This Policy is consistent with the Children’s Online Privacy Protection Act (COPPA) and applicable international children’s privacy laws.

9. Health & Wellness Disclaimer

Floletics is a fitness and educational platform, not a medical service. All content provided through the Services — including exercises, tutorials, and recommendations — is intended for general wellness and educational purposes only and does not constitute medical advice, diagnosis, treatment, rehabilitation, or professional healthcare services. Use of the Services does not create a doctor-patient or other healthcare professional relationship.

(a) No Health Data Collection

Floletics does not collect, store, or process sensitive health data such as:

  • medical records, diagnoses, or test results;
  • biometric or physiological data (such as heart rate, weight, or activity metrics);
  • data from Apple HealthKit, Google Fit, or similar health data platforms.

The Services do not integrate with Apple HealthKit, Google Fit, or any regulated health data platform.

(b) Regulatory Position

Floletics operates as a general wellness platform and is not a covered entity under HIPAA. Floletics does not process regulated health data and is not subject to HIPAA’s privacy or security rules.

(c) User Responsibility

You are responsible for determining whether your physical condition is appropriate for participating in exercise activities. If you are pregnant, recovering from injury, have a medical condition, or have any health concerns, consult a qualified healthcare professional before participating in any exercise program. Stop exercising immediately if you experience pain, dizziness, shortness of breath, or discomfort. Floletics is not responsible for injuries or adverse outcomes resulting from improper technique, misuse of content, or participation beyond your personal limits.

10. Third-Party Services

The Services may integrate or rely on third-party services, including:

  • Apple In-App Purchase — for payment processing and subscription management;
  • Cloud infrastructure providers (e.g., AliCloud International nodes) — for hosting, storage, and video delivery;
  • Analytics providers — for performance monitoring and app improvement.

These third-party providers may process information on our behalf as necessary to operate the Services. Each third-party service operates under its own privacy policy and terms, which may differ from this Privacy Policy. Floletics does not control and is not responsible for the privacy practices of these third parties. We encourage you to review their policies before using such services.

We do not use third-party advertising networks or sell your data to data brokers.

11. Export Compliance

You agree to comply with all applicable export control laws and regulations, including the U.S. Export Administration Regulations (EAR). You may not export, re-export, or transfer the Services or related technology to any country, entity, or individual subject to U.S. trade sanctions or export restrictions.

12. Policy Updates

We may update this Privacy Policy from time to time to reflect changes in legal requirements, technology, or our Services. If changes materially affect how we collect, use, or process personal information, we will provide notice through the Services, by email, or through other appropriate means at least 30 days before the changes take effect.

The “Last Updated” date at the top of this Policy indicates when the most recent revisions were made. Your continued use of the Services after the updated Privacy Policy becomes effective constitutes your acknowledgment of and agreement to the revised Policy.
